Terms of Service

Contract terms for HostKit accounts, subscriptions, restaurant content, SMS/email use, payments, acceptable use, support, disputes, and cancellation.

Acceptance and account authority

  • By creating an account, signing up, checking out, logging in, or using HostKit, the account owner accepts these Terms and the policies linked from these Terms.
  • The person accepting must have authority to bind the restaurant, business, franchise, or organization they represent.
  • HostKit records acceptance evidence such as policy version, timestamp, source, user agent, IP-derived metadata where available, and account or email identifiers.

Services and restaurant responsibility

  • HostKit provides restaurant technology including digital menus, QR/NFC tools, messaging, reservations, reviews, websites, analytics, marketing workflows, AI-assisted tools, onboarding, and support.
  • Restaurants are responsible for the accuracy, legality, safety, ownership, allergen statements, dietary statements, menu prices, promotions, customer communications, and staff use of their content.
  • HostKit may suspend or limit services for abuse, unlawful content, payment failure, security risk, SMS/email compliance risk, or violation of these Terms.

Payments, taxes, refunds, and PCI

  • Subscription, setup, hardware, add-on, tax, discount, and renewal details are shown before purchase or plan change confirmation.
  • Payments are processed by Stripe or another disclosed payment processor. HostKit does not store full payment card numbers or sensitive authentication data.
  • Refunds, cancellations, chargebacks, failed-payment retries, and service shutdown timing are governed by the Refund Policy and Cancellation Policy.

SMS, email, and marketing

  • Restaurants must collect and honor valid consent before sending SMS, MMS, marketing email, review requests, reservation reminders, or promotional campaigns through HostKit.
  • STOP, HELP, unsubscribe, quiet-hour, suppression-list, and consent-revocation requirements must be followed.
  • HostKit may use account, client, guest, and analytics data for HostKit marketing and restaurant marketing only as disclosed in the Privacy Policy, Data Usage Policy, Cookie Policy, and Do Not Sell or Share page.

AI-assisted features

  • AI outputs are drafts and recommendations. Restaurants must review AI-generated descriptions, review responses, messages, menu edits, pricing suggestions, and campaign content before publishing or sending.
  • HostKit may use aggregated or de-identified data to improve products, analytics, and AI-assisted features, but sensitive guest details are not used for advertising or model training.
  • Restaurants remain responsible for ensuring AI-assisted content is accurate, lawful, non-discriminatory, and consistent with their customer commitments.

Disputes and governing law

  • These Terms are governed by North Carolina, United States, except where consumer, privacy, or accessibility law requires another result.
  • Before filing a claim, the parties should attempt to resolve disputes by sending written notice to legal@hostkitapp.com with enough detail to investigate.
  • Liability is limited to the amounts paid for the affected services to the maximum extent allowed by law, and neither party is liable for indirect or consequential damages except where law prohibits that limitation.
